Through a comparative study of two court decisions, this article presents a linguistic analysis of the applicable rules to asylum applicants in France. First, the author underlines the importance of the literary style in the drafting of decisions on the merits. Second, she analyzes the "language of the law" to show how the structure of legal thought sometimes differs from formal logic and common sense, thus justifying legal decisions taken with regard to asylum applicants that could not be rationally justified.Metrics
